On November 14, JSC Acron asked JSC Apatit to reduce apatite concentrate supplies through the end of 2008 because of decreased multi-nutrient mineral fertiliser production. However, CJSC FosAgro AG (JSC Apatit’s managing company) denied Acron's request, recommending that Acron either honour the contract between the two companies or file a claim in arbitration court to alter its conditions.
Acron Board of Directors Chairman Alexander Popov commented on the situation:
“Once again FosAgro is showing us that they will not negotiate with consumers to solve problems. Even though the monopoly supplier is trying to exert pressure on Acron, which is an independent mineral fertilisers producer, I can confirm unequivocally that Acron will, as always, discharge its contractual obligations to Apatit in good faith . However, because Apatit is once again abusing its dominant position and forcing Acron to buy excessive stock, we have no choice but to sell the excess apatite concentrate to third parties.”
